50-year-old Benjamin Howard Anthony of Falls Street in Morganton was arrested Sunday (November 26) by Morganton Public Safety Officers. He’s charged with felony counts of trafficking, opium or heroin, possession of schedule II controlled substance, and maintaining a vehicle, dwelling, or place for controlled substance.
On Sunday, Public Safety officers responded to an intoxicated subject call on West Fleming Drive in Morganton. The Burke County Emergency Communications Center told officers that a white male had driven to the store and had been at the store for more than 30 minutes. The caller described the male as intoxicated and as someone who did not need to be driving.
Officers arrived at the scene and found the individual sitting in his car at one of the gas pumps. The car was not running. Officers checked on the male to ensure he was not intoxicated and was safe to drive. Upon further investigation, the man was found to be intoxicated and was also reportedly in possession of two unmarked pill bottles with a total of 102 hydrocodone pills. The suspect was taken into custody and identified as Benjamin Howard Anthony.
Anthony was initially placed under a 48 hour hold at the Burke County Jail. As of earlier today (November 29), Anthony remained in the Burke County Jail under $15,000 secured bond. His next District Court appearance is scheduled for December 15.
