McDowell County Man Jailed In Burke County On Fugitive Warrant From Florida
46-year-old Ben Lee Capps of Ashworth Road in Marion was arrested last Wednesday (September 13) by Morganton Public Safety Officers. He’s charged with felony possession of schedule II controlled substance, on a felony warrant as a fugitive from justice, and driving during revocation.
Last Wednesday, a Public Safety Officer initiated a traffic stop on Carbon City Road on a black Cadillac for having a severely cracked front windshield. The vehicle’s plate was found to be fictitious. The driver was identified as Ben Lee Capps.
The suspect had a suspended driver’s license and was found to have an outstanding fugitive warrant from Florida with full extradition. During the traffic stop six grams of methamphetamine was seized.
According to the North Carolina Department of Corrections Offender Public Information website, Capps has multiple convictions dating back to 2006. All of the convictions were in McDowell County. The charges include felony and misdemeanor counts. The most recent conviction was in 2017.
Capps was incarcerated in the Burke County Jail under no bond on the fugitive warrant and $5,000 secured bond on the other charges. He remained in jail as of earlier today (September 18). District Court dates are scheduled for October 5 and November 27.
