47-year-old Ben Lee Capps of Marion was arrested by Morganton Public Safety Officers. He’s charged on a felony warrant as a fugitive from another state, felony counts of possession of a weapon by a felon and possession of controlled substance, along with a count of driving during revocation.
Shortly before 9 a.m. last Friday (January 19) a Public Safety Officer initiated a vehicle stop on South Green Street in Morganton. The officer stopped a Cadillac for an expired tag. The driver of the vehicle, Capps, said he did not have a driver’s license. According to police reports, it was learned that Capps is a fugitive from Florida.
Capps is a felon as a result of multiple convictions in the state of North Carolina. According to the North Carolina Department Of Adult Correction Offender Public Information website, Capps has convictions dating back to 2006. His most recent case was in July, 2017 in McDowell County. Capps was convicted of felony counts of speeding to elude arrest and possession of schedule II controlled substance.
Following the arrest, Capps was placed in the Burke County Jail without bond. He remained in jail under no bond as of earlier today (January 25). His first court date on the drug and weapon charges was scheduled for this past Monday (January 22). No upcoming court dates were listed for those charges. A District Court date is scheduled next Monday (January 29) on the fugitive charge.
