Homeless Statesville Man Faces Drug & Child Porn Charges

42-year-old Brian Dean McGarity, who is listed as a homeless person from Statesville, has been arrested by Iredell County Sheriff’s Officers on felony counts of possession with intent to sell or deliver methamphetamine, possession of fentanyl, and ten counts of second-degree sexual exploitation of a minor, along with misdemeanor counts of possession of drug paraphernalia and resisting, delaying, or obstructing a public officer.

McGarity was arrested on December 6 as the result of an investigation that began after numerous citizens’ complaints regarding illegal drug activity in the area of the Best-In-Town Motel on West Front Street in Statesville. Narcotics Detectives and other Officers conducted surveillance in the area and later initiated a traffic stop. A search of the vehicle turned up approximately 26.70 grams of meth and and 1.30 grams of fentanyl with a combined street value of approximately $2,200.

One occupant of the vehicle, Brian Dean McGarity, lied about his identity, but was eventually identified. Through a criminal records search, McGarity was found to have several active warrants for his arrest as an absconder from probation.

McGarity was taken into custody and placed in the Iredell County Detention Center where he was initially given a $176,000 secured bond. Detectives seized McGarity’s cell phone and obtained a search warrant to process it. Investigators found numerous items of child pornography on the phone, including images of child sexual assault. McGarity was charged with sexual exploitation of a minor and given an additional $75,000 secured bond. He’ll appear in Superior Court on the probation warrants on January 16. A District Court date on the child porn charges was set for January 17 with another appearance on the drug charges coming up on January 30.
